What Smith establishes is something different:

Legal citizenship and lived citizenship are distinguishable, and lived citizenship concerns social, political, and economic standing.

That distinction helps explain why legal equality need not produce lived equality.

But it does not, by itself, establish:

“Societies develop historically specific conceptions of who counts as an equal.”

So I am right to notice that gap.
