"Normative and legal choice"

Suppose history establishes:

Temple → Mosque.

History stops there.

Then a government says:

Earlier ownership should prevail.

That is a normative choice because it answers the question

What ought the law to do?

It is also a legal choice because the state turns that normative judgment into legal rules or judicial decisions.

So:

Historical statement

There was once a temple.

Normative statement

Therefore it ought to be restored.

Legal statement

The court orders restoration.

These are three different kinds of statements.
